Release of Liability & Assumption of Risk

By executing this Agreement, the Participant agrees not to sue SD Bull Rental, the Event Host, the Venue, or the Operator for ordinary accidents arising from the Activity. Definitions. “Activity” means use of the mechanical bull and related equipment provided by SD Bull Rental. “Operator” means the Event Host or any person designated by the Event Host to operate the equipment during the Event. “Releasees” means SD Bull Rental, the Event Host/Organizer, the Venue/property owner(s), and the Operator, together with each of their respective parents, subsidiaries, affiliates, officers, directors, members, managers, employees, agents, contractors, volunteers, sponsors, successors, and assigns. “Participant” means the individual named above and his or her heirs, executors, administrators, personal representatives, and assigns.
Equipment Rental & Training Model. SD Bull Rental’s role at the Event is limited to delivering the equipment, setting it up, and providing operating instruction to the Event Host. SD Bull Rental does not operate the equipment during the Event and exercises no operational control or supervisory authority once setup is complete. The Activity is operated solely by the Event Host or persons trained and designated by the Event Host, who accept full operational responsibility — including supervising riders, enforcing safety rules, deciding who rides, and stopping the Activity when appropriate.
Assumption of Risk. Participant acknowledges that the Activity is inherently and unavoidably dangerous and may result in serious bodily injury — including contusions, fractures, concussions, spinal injury, paralysis, and death — arising from falls, throws, equipment movement or malfunction, Operator inexperience or error, environmental conditions, or the conduct or condition of any person. Participant expressly, knowingly, and voluntarily assumes all such risks, whether known or unknown, including those caused or contributed to by the ordinary negligence of any Releasee, including the Operator.
Release. In consideration of being permitted to participate, Participant hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the Releasees from any and all liability, claims, demands, causes of action, damages, costs, and expenses, in law or equity, arising out of or relating to the Activity, including any liability arising from the ordinary negligence of any Releasee or the Operator; this release does not extend to gross negligence or willful misconduct.
Indemnification. Participant shall INDEMNIFY, DEFEND, AND HOLD HARMLESS each Releasee from and against any claims, damages, costs, and reasonable attorneys’ fees arising out of Participant’s participation or any act or omission causing injury or damage to a third party.
California Civil Code §1542. Participant expressly waives all rights and benefits under §1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” This Agreement extinguishes all claims, known and unknown.
Insurance. Participant’s insurance is primary; the Releasees bear no responsibility for medical or related expenses.
Photos & Videos. We love sharing the fun! By signing, Participant gives SD Bull Rental, the Event Host, and the Venue permission to use Participant’s photos, videos, name, and likeness from the Event for marketing — including social media, ads, websites, and partner promotions — forever, anywhere, in any format (including future or AI-generated media), with no further notice and no payment. This permission may be shared with our partners and platforms and can’t be withdrawn later.
Arbitration; Class Action Waiver. Any dispute shall be resolved exclusively by final and binding individual arbitration administered by JAMS in San Diego County, California. Participant waives any right to trial by jury and any right to participate in any class, collective, or representative proceeding. If arbitration is held unenforceable, venue lies exclusively in the state or federal courts of San Diego County, California. Governed by California law. ESIGN/UETA: electronic signatures hold the same effect as manual. Entire agreement; severable.
